Terms of Service

1. Scope and Parties
These Terms of Service („Terms") govern the use of the web application Committo, available at committo.app and associated subdomains („Service"). The provider of the Service is:

(referred to as „Committo", „we" or „us"). Users of the Service are referred to as „you" or „User".
By creating an account or using the Service, you agree to these Terms. Any deviating arrangement requires text form. Your own general terms and conditions only apply if we have expressly consented to them.
2. The Service at a Glance
Committo is a tool for voluntary self-commitment and progress tracking. Its features include:
- Commitments — creating measurable goals (title, target value, unit, cycle) with weekly check-ins.
- Pacts — sharing selected commitments with accountability partners (title and status only, never numerical values).
- AI Coach (Pro) — optional AI-assisted conversational support during onboarding and ongoing for Pro members. You choose a coaching mode:
- Just track — no coaching, no sensitive data;
- Better habits — coaching chat and optional mood capture on shortfall check-ins;
- Coach & grow — additionally a monthly review, quarterly redesign, personal values and life-domain ratings.
- Email reminders — check-in, pact-related and (for Pro) coaching-ritual reminders.
Committo is not a medical device and is not a substitute for medical, psychological, psychotherapeutic, legal, or financial advice. For details on data processing — including the explicit Art. 9 GDPR consent for reflective coaching modes — see our Privacy Policy.
3. Account and Eligibility
To use Committo you must create an account. You warrant that:
- you are at least 16 years of age;
- the email address you provide belongs to you and is correct;
- you do not share your credentials (in particular the one-time code sent to your email) with third parties;
- you create only one account per person.
You can delete your account at any time in Settings under „Danger Zone → Delete Account". Deletion ends the contract.
4. Free Tier and Pro Membership
Committo is offered at two tiers:
- Free: free use with up to two active commitments, check-ins, pacts, and AI-assisted onboarding.
- Pro: unlimited active commitments and ongoing access to the AI Coach. Pro includes — to the extent you activate the relevant coaching mode and (for reflective modes) provide your Art. 9 GDPR consent — in particular:
- ongoing coaching chat;
- monthly review chat;
- quarterly redesign;
- structured coach memory with versioning;
- optional capture of mood, personal values and life-domain ratings.
The current feature set of each tier is documented on committo.app. We reserve the right to move individual features between tiers provided the paid scope of the Pro membership is not materially reduced (see Section 15).
5. Prices, Payment and Merchant of Record
For the Pro membership the prices displayed at the time of checkout apply. These are currently:
- Monthly: €5.99 / month (including applicable VAT in your country)
- Annual: €34.99 / year (including applicable VAT in your country)
Payment processing and invoicing are handled by our payment provider Lemon Squeezy, LLC (1603 Capitol Ave., Suite 310 A485, Cheyenne, WY 82001, USA), acting as Merchant of Record (MoR). The payment contract (purchase of the Pro membership, invoicing, and VAT collection) is therefore formed directly between you and Lemon Squeezy. Lemon Squeezy's terms additionally apply.
We only receive the subscription metadata required to enable Pro features (status, plan, renewal date). We are responsible for providing the Service; Lemon Squeezy is the primary point of contact for billing, invoicing, and tax matters.
6. Term, Auto-Renewal and Cancellation
The Pro membership is offered as a monthly or annual subscription and automatically renews for another billing period (one month or one year respectively) unless cancelled before the end of the current period.
You may cancel at any time without giving reasons. In accordance with § 312k BGB you can end your subscription with a single click via the Lemon Squeezy customer portal, accessible through Settings → Membership → „Manage subscription" in Committo. Alternatively, an informal email to hello@committo.app is sufficient.
Upon cancellation your Pro access remains active until the end of the paid billing period; your account is then automatically downgraded to the Free tier. Amounts already paid are refunded only to the extent provided in our Refund Policy or as required by mandatory law.
7. Right of Withdrawal for EU Consumers
Withdrawal instructions. You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day of the conclusion of the contract. To exercise your right of withdrawal, you must inform us (Daniel Lebe Softwareentwicklung, Tullingerstraße 14a, 80939 München, hello@committo.app) or the Merchant of Record Lemon Squeezy by means of an unequivocal statement (e.g., a letter sent by post or an email) of your decision to withdraw from this contract.
Effects of withdrawal. If you validly withdraw, we will reimburse any payments you have made without undue delay and no later than 14 days thereafter.
Early expiry of the right of withdrawal for digital content (§ 356(5) BGB). Because Committo is a digital service that you can use immediately after upgrading, your right of withdrawal expires if you expressly consent in the Lemon Squeezy checkout to us starting performance before the end of the withdrawal period and simultaneously acknowledge that you lose your right of withdrawal as a result. Lemon Squeezy obtains this consent in the checkout form.
8. Refunds
Details on refund processing are set out in our Refund Policy. Statutory rights — in particular the right of withdrawal under §§ 355, 356 BGB and warranty rights for defects (see Section 14) — remain unaffected.
9. Acceptable Use
When using Committo you agree not to infringe applicable law or the rights of third parties. In particular, you must not:
- enter unlawful, offensive, discriminatory, harassing, sexualised, violence- glorifying or otherwise objectionable content in commitments, check-ins, notes or the AI chat;
- enter personal data of third parties without their consent (in particular, do not invite third-party email addresses to a pact without the recipient's consent);
- query, scrape, or burden the Service in an automated fashion beyond what is reasonably necessary for regular use;
- circumvent security measures, exploit vulnerabilities, or introduce malware;
- abuse the AI features to generate content that violates our AI provider's usage policies (e.g., hate speech, CSAM, instructions for violent acts);
- rely on the AI Coach as a sole point of contact in an acute crisis or medical / psychiatric emergency — Committo is not designed for that purpose (see Section 12);
- resell or sublicense the Service commercially on behalf of third parties without our prior agreement.
Emergency notice. If you or someone else are in immediate danger, please contact your local emergency services or an established crisis line in your country right away. The AI Coach cannot and must not provide emergency or suicide counselling; when it detects signs of acute self-harm or harm to others it will pause its response and refer you to reputable crisis-support services.
In case of violations we may remove content, temporarily restrict usage, or — for severe or repeated violations — terminate the contract for cause (Section 15).
10. User Content and Licence
Content you enter into Committo — in particular commitments, check-ins, notes, chat input in the coach, monthly review and quarterly redesign, mood entries, personal values, and life-domain ratings — remains your property. You grant us a non-exclusive, worldwide licence, limited to the term of your use, to store this content, process it, allow the AI coach to derive structured insights („coach memory") from it, forward it to our processors (e.g., Supabase, Google Gemini) solely for the purpose of providing the Service, and — within the Pact feature — to display the title and status of shared commitments to the recipients you select.
Where content may include special category personal data under Art. 9 GDPR (mood, health, philosophical or political views, relationship situations), processing takes place exclusively on the basis of your explicit consent, which you may withdraw at any time in Settings (see Section 12 and the Privacy Policy).
You warrant that you have all necessary rights in the content you enter and that entering it does not violate any third-party rights.
11. Pacts and Partner Data
When you invite another person to a pact by email, you confirm that you are entitled to use that email address. We do not warrant that invited persons will accept your invitation. Pact partners only see the title and status of shared commitments — never your numerical values, notes, or chat content. You may un-share individual commitments or end the pact at any time.
12. AI-Powered Features, Coaching Modes and Controls
Our AI Coach (including onboarding suggestions, coaching chat, monthly review and quarterly redesign) is based on generative AI (Google Gemini) and may contain errors, be outdated, or respond out of context. Outputs are advisory and open-ended and do not replace professional advice — in particular, no medical, psychiatric, psychotherapeutic, legal, tax, or financial advice. Committo is not a medical device and is not intended for the diagnosis, prevention, monitoring, or treatment of disease.
Coaching mode and data minimisation. You decide under Settings → Coaching mode how deep the coach should go („Just track", „Better habits", or „Coach & grow"). Reflective modes require your explicit consent under Art. 9(2)(a) GDPR, which we capture in the mode selector and which you may withdraw at any time in Settings with a single click. On withdrawal, your coaching mode is automatically reset to „Just track" and reflective features are disabled server-side.
Coach memory. In a reflective mode the coach builds a structured „memory" from your inputs (e.g., recurring obstacles, important values). You can review this memory at any time under Settings → Memory, edit individual entries, delete them, or revert them to a previous version.
Crisis signals. Before each coach response we screen your input for acute crisis signals (e.g., self-harm or harm to others). When such a signal is detected, the coach will not respond and instead refers you to reputable external support services. This heuristic is not a diagnostic tool and does not replace professional crisis intervention; it is part of our duty of care.
No solely automated decision-making within the meaning of Art. 22 GDPR takes place; every decision to accept or reject a suggestion rests with you. The crisis-signal heuristic also does not produce a decision with legal effect — it merely pauses the coach reply in favour of external help.
13. Intellectual Property and Trademarks
All rights to the software, design, texts, graphics, logos, and the „Committo" trademark belong to us or our licensors. For the term of the contract you receive a non-exclusive, non-transferable right to use the Service as intended. Any reproduction, distribution, decompilation, or modification beyond that requires our prior written consent, unless expressly permitted by law (in particular § 69d UrhG).
14. Warranty for Digital Products
The provision of the digital Service is subject to §§ 327 et seq. BGB. We are obliged to provide the Service in a contractually compliant condition for the term of the contract and to provide updates required to maintain conformity. In the event of material defects you may exercise the statutory rights (supplementary performance, reduction, termination and, where applicable, damages).
The Service is provided „as is" within the current state of the art; uninterrupted availability is not guaranteed. Where possible, we will schedule planned maintenance outside typical usage hours.
15. Changes to the Service and to these Terms
We may further develop, extend, or modify individual features of the Service provided this is reasonable for you and does not materially reduce the contractual scope of performance. Material changes affecting your rights and obligations under this contract will be announced at least 30 days in advance by email or a conspicuous in-app notice. If you object within that period, your contract ends at the end of the then-current billing period.
Price changes will be communicated in the same way with at least 30 days' notice and apply only to future billing periods.
16. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and within the scope of any warranty we have assumed.
For slight negligence we are only liable in the event of a breach of a material contractual obligation (cardinal duty) the performance of which makes the proper execution of the contract possible in the first place and on whose observance you may regularly rely. In such case our liability is limited to the foreseeable damage typical of the contract. Liability for slight negligence is otherwise excluded.
For the loss of user content we are liable only to the extent that you have not failed to take reasonable backup measures (e.g., exporting your data). We point out that your Committo data is self-service exportable (in preparation) or will be provided on request.
17. Data Protection
What data we process, for what purpose, your rights, and which processors we engage are described in detail in our Privacy Policy, which forms an integral part of our contractual relationship.
18. Governing Law and Dispute Resolution
This contract is governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer within the meaning of § 13 BGB and habitually reside in the EU, the mandatory consumer protection provisions of your country of residence remain unaffected.
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
19. Final Provisions
Should any provision of these Terms be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the applicable statutory rule.
Unless mandatory law provides otherwise, the place of performance and exclusive venue for all disputes arising from or in connection with this contract is Munich, provided that you are a merchant, a legal entity under public law, or a special fund under public law.
